Previously, New York had been the only state in the nation to require notarized documents completed out-of-state to include additional paperwork—a Certificate of Conformity—before being accepted. This 80-year-old, anachronistic requirement often slowed down or stopped the acceptance of notarized documents from out of state and required consumers and businesses to hire an attorney to be completed. It was a costly and time-consuming experience that hindered business transactions and delayed consumers’ access to critical documents.
HPA leaned into viewing this issue through a lens of embracing technology for its intended purpose, making the world more efficient. New York has long championed initiatives to modernize and improve state services, highlighting that residents’ ability to access online notarization services eliminates another unnecessary burden for New Yorkers was key to our approach.
Engaging in an awareness campaign that educated legislators on the issue and provided guidance around the technical and security related questions raised generated early momentum. Working with legislation co-sponsors State Sen. John Liu, Assembly Member Clyde Vanel, and a broad coalition of aligned partners, the law (S.2271/A.3225), signed by Gov. Kathy Hochul on November 22, 2024.
